FSSAI License / Food License Registration in India

The Food Licensing and Registration System provides the Food License, also known as an FSSAI License, which determines food quality. A Food Licensed person is only authorized to sell their Food. As per Section 31(1) of the FSS Act, 2006, Food Licensing is mandatory for Food Business Operators in India.

In 2006, the Food Safety and Standards Authority of India (FSSAI) made an FSSAI License compulsory for every food business and food product. This FSSAI registration process makes safe and standardized foods readily available to customers.

According to the FSSAI Food Business Regulation Act, only small food manufacturers and sellers can start a food business without a registration process (FSSAI); only FSSAI-licensed or registered persons are allowed to Sell Food Products. This small food business involves an individual or a group of people selling food from hawkers’ stalls, temporary stalls, or distributing Food to social gatherings or religious meetings. Apart from these businesses, anyone starting a food-related business must obtain an FSSAI registration. The following are the eligibility requirements, fees, and documents required for an FSSAI Registration.

Eligibility for FSSAI License

  • Each food business owner has an annual turnover that does not cross the income of INR 12 Lakhs per year
  • Any food retailer that deals in food products.
  • An individual who manufactures or sells any food product by themselves.
  • If the temporary stallholder sells food products.
  • Any cottage food industry or small-scale food business that deals in food has a food production capacity of up to 100 kg or 100 liters per day. However, this production capacity does not include meat production and meal production.
  • Any small-scale food industry procures, collects, and handles up to 500 LITERS of milk daily.
  • Any food industry or small-scale industry that has the slaughtering capacity of accommodating two large animals, ten small animals, or fifty poultry birds per day.
  • An individual distributes Food at any religious or social gathering, except for a caterer.

Documents Required to Apply For an FSSAI License

  • Proof of photograph.
  • ID proof, such as Aadhaar, Voter ID, passport, or PAN.
  • Proof of premises possession – In case any difference is mentioned in the ID Proof.
  • Declaration form.

FSSAI Registration

Small-scale food businesses should obtain an FSSAI registration by filing Form A with the food safety department. The Food Safety Department authorities can reject the registration application within seven days after written notification. Once this registration is processed, you can use this and start your business. This FSSAI registration should be displayed in the food business premises at all times.

Any entity that does not fall under the category of a small-scale business must obtain an FSSAI license to operate a food business in India. There are two types of FSSAI licenses: the State FSSAI License and the Central FSSAI License. Depending on the nature and size of the business, this authority would change. Transporters, manufacturers, and importers of food products in a large-scale food business need a central FSSAI license. On the other hand, the state FSSAI license is mandatory for medium-sized food processors, manufacturers, and transporters.

The FSSAI license application is registered through Form B to the concerned food safety Licensing Authority along with the mandatory self-attested declaration, annexures, and affidavit. This license is granted for a period of 1 to 5 years, as requested by the food business owner. The longer the license is active, the higher the license cost will be. If the registration is obtained for 1 to 2 years, the FSSAI license can also be renewed by filing another application within 30 days of the current FSSAI license’s expiry date.

FSSAI Certificate Cost

  1. FSSAI Certificate Cost for a new application is Rs. 7500 for 1 year.
  2. FSSAI License/certificate renewal fees are Rs. 7500 for 1 Year.
  3. FSSAI License/Certificate Modification Fee is Rs. 7500 for 1 year

Documents Required for FSSAI Central License

  1. Form B is duly signed and completed by the owner or proprietor.
  2. Blueprint or layout of the business area location.
  3. Contact details of the Business Directors.
  4. List and provide details of the types of machinery equipment.
  5. Details of food items to be manufactured
  6. The owner’s photo of their roof, as issued by the Government of India, is required. In the case of a company, evidence from a director or photographer is needed.
  7. Water report analysis from a recognized public health laboratory.
  8. Proof of premises possession.
  9. Pesticide residues are reported in water if units manufacture carbonated water or minerals from hazardous sources.
  10. Copy of the license and NOC from the manufacturer.
  11. Food Safety Management System plan or certificate.
  12. Source of milk( if applicable).
  13. Source of meat and meat processing units ( if applicable).
  14. NOC from the municipality and local body (if applicable).
  15. MCA Incorporation Certificate ( if applicable).
  16. Supporting proof of turnover( if applicable).
  17. NOC/PA issued by FSSAI
  18. IE Code issued by DGFT (The Directorate General of Foreign Trade) for importers.
  19. Certificate provided by the Ministry of Tourism ( if applicable).
  20. Supporting proof of turnover for vehicles, if applicable.
  21. FSSAI Declaration Form.

FSSAI Central License Fees

The FSSAI central license Fee for one Year is Rs 7,500, and the FSSAI registration fee for one year is Rs 100. Note: The FSSAI License/Certificate can be applied for a maximum of five Years at a time.

  1. The fee for a new FSSAI license is Rs 7500
  2. The fee for a renewed FSSAI license is Rs. 7500
  3. The fee for modification of the FSSAI license is Rs. 7500
  4. The fee for an FSSAI duplicate license is Rs 10

Documents Required for FSSAI State License

  1. Form B is duly completed and signed by the owner.
  2. Blueprint and layout of the area location.
  3. Contact details of the directors of the business.
  4. Details of the types of equipment and machinery. The government of India.
  5. List of food categories that must be manufactured.
  6. An authority letter with the name and address of the director or owner.
  7. Proof of possession of premises.
  8. Partnership affidavit of proprietorship/owner.
  9. Copy of License and NOC ( No Objection Certificate) from the manufacturer.
  10. Food Safety Management System Plan/certificate obtained.

Fee Structure for The FSSAI State License

  1. A fee of RS. $ 5,000 is applicable for productions that exceed 1 Megaton and for milk units ranging from 10,001 to 50,000 LPD or 501 to 2,500 megatons per annum.
  2. A fee of Rs. 3,000 is applicable for productions below 1 Megaton and for milk units ranging from 501 to 10,000 LPD (Lighting Power Density) or 2.5 to 500 Megaton per annum.
  3. A fee of Rs . 5,000 is applicable for hotels ranging from 4-star.
  4. A fee of Rs. 2,000 applies to All Food Service providers and several other Food Business Operators in the State.
